Overall Plan for Better Promoting Employment of Persons with Disabilities
The Central Committee of the Communist Party of China and the State Council attach great importance to ensuring the employment of persons with disabilities. Since the establishment of the employment security fund system for persons with disabilities in the 1990s, it has played an important role in enhancing the awareness of social responsibility for the employment of persons with disabilities and promoting their employment.In recent years, with the development of the economy and society and changes in the employment situation of persons with disabilities, issues such as the insufficient role of the employment security fund (hereinafter referred to as the 'disability employment fund') have become increasingly prominent, necessitating improvement. In order to better utilize the disability employment fund system and effectively promote the employment of persons with disabilities,
the following plan is formulated.
1. Overall Requirements
(1) Guiding Ideology.
Adhere to Xi Jinping's Thought on Socialism with Chinese Characteristics for a New Era as the guiding ideology, thoroughly implement the spirit of the 19th National Congress of the Communist Party of China and the second, third, and fourth plenary sessions of the 19th Central Committee, uphold the people-centered development philosophy, maintain the general tone of seeking progress while ensuring stability, and follow the approach of stabilizing the institutional framework, optimizing the collection structure, standardizing fund usage, and improving incentive constraints. By improving the management system for the collection and use of the disability employment fund as a starting point, further enhance the employment capacity of persons with disabilities and the service capacity for their employment, actively expand diverse employment channels for persons with disabilities, and make every effort to promote their employment, facilitating their better integration into society and sharing the achievements of economic and social development.
2. Basic Principles.
(2) Basic Principles.
—— Adhere to Overall Consideration.Systematically optimize the collection structure of the disability employment fund, stabilizing the framework of the collection system while actively responding to the demands of employers (hereinafter referred to as 'employers'), better utilizing the role of the disability employment fund system, and promoting employers to increase employment positions for persons with disabilities through 'effective collection', gradually forming a virtuous cycle of increased employment and reduced costs, achieving a win-win situation for the employment of persons with disabilities and the healthy development of employers.
—— Adhere to a People-Centered Approach. Discrimination against persons with disabilities in employment is prohibited. Further make good use of the disability employment fund, improve precise reward and subsidy policies, encourage employers to match jobs to individuals and create positions based on individual capabilities, better meet the employment needs of persons with disabilities, and create a more inclusive and caring employment environment. Through 'effective use', enhance the employment capabilities of persons with disabilities and promote them to achieve more stable and higher-quality employment.
—— Adhere to Multiple Measures. Addressing the prominent issues in the current employment of persons with disabilities, improve the disability employment fund system as a starting point, simultaneously enhance employment protection, support, and services for persons with disabilities, focus on strengthening weaknesses and filling gaps, fully mobilize the enthusiasm of persons with disabilities for employment and entrepreneurship, and leverage the collaborative efforts of multiple stakeholders to better ensure the employment of persons with disabilities.2. Optimize Collection, Effectively Reduce Employer Costs
(3) Implement Tiered Collection. Adjust the collection of the disability employment fund from a single standard to a tiered collection. For employers with a disability employment ratio of 1% (inclusive) or above but below the ratio stipulated by the province (region, city), collect 50% of the payable amount for three years; for those below 1%, collect 90% of the payable amount for three years.
(4) Temporarily Exempt Small and Micro Enterprises from Disability Employment Fund Collection. For enterprises with a total number of employees of 30 (inclusive) or fewer, temporarily exempt them from the disability employment fund.(5) Clarify the Social Average Wage Standard. The upper limit of the collection standard for the disability employment fund will still be implemented at twice the local social average wage, with the social average wage defined as the weighted average wage of employees in urban private and non-private units.
(6) Reasonably Recognize Proportional Employment Arrangements. Explore various forms of proportional employment for persons with disabilities, providing more options for employers to fulfill their legal obligations. If employers legally employ persons with disabilities through labor dispatch, the Disabled Persons' Federation (hereinafter referred to as 'Federation') will include the number of employed persons with disabilities in its review and strengthen dynamic monitoring.
3. Standardize Use, Better Ensure Employment of Persons with Disabilities
(7) Clarify that the Disability Employment Fund is Prioritized for Employment Security. The disability employment fund should be prioritized for supporting the employment of persons with disabilities, covering relevant training, education, reward subsidies, employment services, and other expenditures directly related to the employment of persons with disabilities, as determined by each province. Localities should reasonably arrange related expenditures based on the actual needs for ensuring the employment of persons with disabilities, and must not determine expenditures based on collections.(8) Increase Incentives for Employers to Arrange Employment for Persons with Disabilities. Reasonably adjust the subsidy standards for employment positions for persons with disabilities, insurance subsidies, and subsidies for the purchase and renovation of facilities and equipment; increase rewards for employers who exceed the proportional employment of persons with disabilities, and stimulate employers' enthusiasm for arranging employment for persons with disabilities through positive incentives.
(9) Support Self-Employment and Entrepreneurship for Persons with Disabilities. Encourage and guide persons with disabilities to engage in self-employment and entrepreneurship using forms such as 'Internet+' and provide support in terms of operating venues, with eligible individuals able to enjoy corresponding subsidies and financial support policies.
(10) Improve the Quality of Vocational Training. Actively support employment training for persons with disabilities, further enhance the efficiency of fund usage. Rely on employers with employment intentions for persons with disabilities and professional training institutions to carry out 'apprenticeship' and position-based training, paying based on training outcomes, using employment conversion rates and stable employment duration as payment criteria. Develop vocational training standards for persons with disabilities based on their characteristics. Conduct free vocational skills training for persons with disabilities as required to improve their employment stability.
4. Strengthen Supervision, Enhance Social Support
(11) Strengthen Social Supervision of the Disability Employment Fund and Proportional Employment of Persons with Disabilities. The Ministry of Finance will report to the State Council annually on the previous year's income from the disability employment fund and expenditures for the cause of persons with disabilities according to budget management regulations. The China Disabled Persons' Federation and other departments and units will report to the State Council on the support for the employment of persons with disabilities and the proportional employment arrangements by employers. Financial departments at the provincial, municipal, and county levels, in conjunction with the local Federation, will regularly disclose the above situations to the public for social supervision.
(12) Incorporate into the Social Credit Evaluation System. Employers who fail to arrange proportional employment for persons with disabilities and refuse to pay or underpay the disability employment fund will have their dishonest behavior recorded in their credit records and included in the national credit information sharing platform.
5. Improve Services, Enhance the Quality of Employment for Persons with Disabilities
(13) Conduct Comprehensive Surveys of Employment Demand Information for Persons with Disabilities. The Federation will guide urban and rural community service agencies to track information on persons with disabilities in real-time, adopting a segmented responsibility approach to accurately grasp the employment needs of persons with disabilities in the area, establish job-seeking information files for persons with disabilities, and assist in employment matching. Establish and improve a nationwide networked identity verification system for persons with disabilities.
(十一)加强残保金和残疾人按比例就业的社会监督。财政部每年按照预算管理规定向国务院报告上一年残保金收入和残疾人事业支出情况,中国残联等部门和单位向国务院报告支持残疾人就业、用人单位按比例安排残疾人就业的情况。省、市、县三级财政部门会同同级残联将辖区范围内上述情况定期向社会公开,接受社会监督。
(十二)纳入社会信用评价体系。对未按比例安排残疾人就业且拒缴、少缴残保金的用人单位,将其失信行为记入信用记录,纳入全国信用信息共享平台。
五、健全服务,提升残疾人就业质量
(十三)全面摸排残疾人就业需求信息。由残联指导城乡社区服务机构实时跟踪残疾人信息,采取分片包干形式,精准掌握辖区内残疾人就业需求,建立残疾人求职信息档案,配合做好就业对接。建立健全全国联网的残疾人身份认证系统。
14. Develop human resources for people with disabilities. Led by the Disabled Persons' Federation, organize various forces, or introduce specialized organizations and market institutions through government procurement of services, to provide a full chain of personalized services for people with disabilities, including vocational rehabilitation training, vocational adaptation assessment, vocational psychological assessment, job orientation guidance, job placement, and job support.
15. Promote the establishment of employment positions for people with disabilities by employers. Government agencies, public institutions, and state-owned enterprises at all levels should take the lead in recruiting and placing people with disabilities in jobs. Employment service agencies for people with disabilities at all levels should actively introduce preferential policies for employing people with disabilities to employers and provide consultation on job modifications, fully mobilizing employers' enthusiasm for arranging employment for people with disabilities; encourage and guide employers to make proactive adaptive adjustments to job positions based on the conditions of people with disabilities, striving to achieve 'matching the job to the person'.
16. Support the development of employment service platforms. Fully leverage the role of employment service centers for people with disabilities, public employment service agencies, labor dispatch companies, and commercial human resource service organizations in connecting the supply and demand for employment of people with disabilities, and provide rewards based on the number of people with disabilities recommended for stable employment for over a year.
17. Promote information sharing and resource sharing. Relevant departments and units such as provincial finance, taxation, human resources and social security, and the Disabled Persons' Federation should establish a mechanism for sharing information on the employment of people with disabilities and the disability employment subsidy. Under the premise of protecting the privacy of people with disabilities, the Disabled Persons' Federation should open employment-related data on people with disabilities to public employment service agencies, labor dispatch companies, commercial human resource service organizations, and legal aid organizations. Promote the interconnection of job-seeking information for people with disabilities across the province and gradually achieve national information sharing. Support the construction of online service platforms for the employment and entrepreneurship of people with disabilities.
18. Improve the employment service guarantee mechanism for people with disabilities. Actively leverage the role of employment service agencies for people with disabilities in providing full-process services before, during, and after employment, and encourage enterprises, disabled employees, and employment service agencies to sign tripartite agreements. Vigorously promote employer liability insurance, accidental injury insurance for people with disabilities, etc., with premiums reasonably shared between enterprises and people with disabilities, eliminating concerns for both parties.
19. Establish a tracking and feedback mechanism for employment information of people with disabilities. The Disabled Persons' Federation and communities should continuously follow up and understand the employment situation of people with disabilities, and promptly coordinate and resolve issues that arise during the employment of people with disabilities and the hiring process by employers. Establish a job counselor system to provide employment services for people with disabilities, timely coordinate and resolve difficulties faced by people with disabilities after employment, and improve the stability and quality of employment for people with disabilities.
6. Strengthen overall planning and collaboratively promote policy implementation.
20. Strengthen organizational leadership. All regions should attach great importance to the employment of people with disabilities, create conditions to help employers increase employment for people with disabilities, more effectively utilize the role of the disability employment subsidy system, and provide a better environment and more support for employers arranging employment for people with disabilities. Timely coordinate and resolve difficulties and problems encountered in the employment of people with disabilities, and regularly summarize good experiences and practices that promote the employment of people with disabilities, promoting those that meet conditions in a timely manner.
21. Strengthen departmental responsibilities. Governments at all levels and relevant departments should prioritize the protection of the labor and employment rights of people with disabilities, clarify responsibilities, cooperate, and work together to form a joint force. The human resources and social security department should incorporate the employment of people with disabilities into the local labor employment and human resource development policy system, and legally safeguard the labor rights and interests of disabled employees. The Disabled Persons' Federation is responsible for reviewing the employment arrangements for people with disabilities by employers and further playing its role in project arrangements and fund utilization. The finance department is responsible for the daily supervision of the collection and use of the disability employment subsidy. The taxation department is responsible for the collection of the disability employment subsidy based on the employment situation of people with disabilities reviewed by the Disabled Persons' Federation. The audit department conducts audits according to laws and regulations, and refers any discovered illegal activities to the relevant departments as per regulations.
22. Create a favorable atmosphere. Relevant departments and local governments at all levels should interpret policies well, strengthen public opinion promotion and exemplary demonstrations, guide all sectors of society to correctly recognize the positive role of the disability employment subsidy, and timely organize inspirational examples of employment for people with disabilities and advanced units arranging employment for people with disabilities to carry out promotional activities, forming a demonstration effect, encouraging people with disabilities to better integrate into society, and calling on the whole society to care for and support the employment of people with disabilities. This plan will be implemented starting from January 1, 2020.
