　　Kunming Security Service Industry self-discipline Convention

　　Chapter I General Rules

　　Article 1 In order to establish and improve the self-discipline mechanism of Kunming security industry, standardize the behavior of enterprises, safeguard the overall interests of the industry, protect the legitimate rights and interests of customer units, and promote the sustainable and healthy development of the industry, according to the "Regulations on the Management of Security Services", "National Occupational Standards for Security guards", "Security service operation standards and quality control" and other laws and regulations and relevant provisions promulgated by The State Council,This Convention shall be formulated in light of the actual situation of the security industry of this Municipality.

　　Article 2 The basic principles of this Convention are: abiding by the law, honesty and self-discipline, standardized operation, fair competition and common development.Article 3 This Convention is the rules of conduct jointly observed by the member enterprises in the operation of service activities through mutual agreement in accordance with national laws and regulations and relevant rules.

　　The member enterprises joining the Kunming Security Association (hereinafter referred to as the "Association") shall sign the legal representative of the unit or the representative entrusted by the unit to undertake to fulfill this Convention.

　　Article 4 This Convention is the basic and supporting document for member units to sign security service contracts (agreements).

　　Article 5 The Kunming Security Association shall perform the functions of organizing and coordinating, inspecting and supervising, praising the performance of the Convention, dealing with breach of contract and revising and interpreting this Convention.

　　The Secretariat of the Association is the working body of this Convention.

　　Chapter II Self-regulation provisions

　　Article 6 Abide by the law

　　(1) Conscientiously abide by various laws, regulations and policies of the State, conscientiously fulfill legal obligations, do not harm the interests of the state, the social public interests, the overall interests of the industry and the legitimate interests of customers, and prevent the occurrence of illegal sexual activities;

　　(2) To safeguard the legitimate rights and interests of security practitioners, and take the initiative to listen to the reasonable opinions and requirements of security practitioners;

　　(3) The signed security service contract shall conform to the requirements of the model contract text formulated by the government and shall be filed with the competent government department for the record;

　　(4) The security services provided shall meet the technical standards and norms prescribed by the State, and the equipment and products used shall meet the quality standards of the State;

　　(5) Sell and install security technology products, strictly abide by the Product Quality Law, ensure product quality, and refrain from selling or using fake and shoddy products;

　　(6) To charge fees in strict accordance with the fee standard agreed in the contract or the price standard stipulated by the government, with the price clearly marked and the operation standardized.No arbitrary charges, overcharges or repeated charges shall be allowed under false pretenses.All charges issued regularinvoice

　　Article 7 Good Faith

　　(1) Strictly fulfill the service commitments agreed upon in the security contract, and provide security services that match the quality and price;

　　(2) Conscientiously safeguard the legitimate rights and interests of the customer units, keep secrets, and do not use the information of the customer units to engage in business activities other than those agreed in the security service contract;

　　(3) Not to harm the legitimate rights and interests of customer units by taking advantage of technological advantages or work convenience, and not to encroach on public or private property of customer units.

　　Article 8 Fair competition.

　　(1) Conscientiously observe the principles of market competition in accordance with the law, openness, fairness and justice, maintain normal market order, and refrain from seeking business by unfair means such as denigrating the business reputation of other units in the industry, stealing or divulging their business secrets or false publicity, seeking customers by lowering prices regardless of costs, or disrupting business order by operating in ways that violate policies and regulations;

　　(2) In participating in the bidding and bidding of security service projects, do not malign price pressure or price gorging, do not participate in the bidding and bidding by improper means such as lower than the industry annual minimum cost price standard, bribery, kickback, etc., do not sign the "yin-yang contract" with the bidding unit.

　　(3) When participating in security service projects that are not tendering and bidding, it shall not obtain service priority by bribery, kickback and other improper means, and it shall not sign "yin-yang contract" with customer units.

　　(4) In the process of handing over security service projects, we should not set up obstacles or create conflicts with each other. We should proceed from maintaining harmony and stability and protecting the interests of customers, and do a good job in all handover work according to law and regulations.

　　Article 9 Standardized Operation

　　(1) Member units should strengthen the training, education and team management of security guards, so as to hold the certificate and abide by the discipline, open system and norm, and constantly improve the comprehensive quality and ability of security guards;

　　(2) Member units shall maintain the normal order of employment within the industry and abide by the ethics of the industry;

　　(3) To carry out an open working system and procedures, and ensure that all people receive services from Monday to Sunday, Prompt reception efficiency 100% ,and a customer satisfaction rate of over 90%;

　　(4) Effectively handle letters and visits complaints, effective customer complaints processing in time rate of 100%, Valid complaint Return visit ratio100%, satisfaction rate of more than 90%.

　　Article 10 Accept supervision

　　(1) Consciously accept the guidance and supervision of security service activities by competent government departments, constantly improve the service and improve the work;

　　(2) Consciously accept the self-discipline management of the industry by the Association. In case of disputes arising from business activities between members of the Association, they shall take the initiative to request the Association to mediate, and properly handle the disputes with a view to maintaining the industry image and with an attitude of mutual understanding;

　　(3) Consciously supervise each other with customer units, solicit opinions from customer units regularly, resolve conflicts and disputes in a timely manner, and maintain stability.

　　Chapter III Implementation of the Convention

　　Article 11 The Association shall select 20 security personnel from its member enterprises to form an inspection team, which shall be under the command of the secretariat of the Association and be responsible for the daily supervision and inspection of the implementation of this Convention and the handling of specific affairs.

　　Article 12 Members of the Association shall take the initiative to report to the secretariat of the Association any violation of this Convention in the operation of service activities.

　　Other members shall have the obligation to timely complain and report to the secretariat of the Association.

　　Article 13 After receiving the report and complaint, the secretariat of the Association shall, in accordance with the principle of seeking truth from facts, organize the supervision brigade to carry out investigation and evidence collection, and report the investigation results and handling opinions to the president's office for examination and approval before publicizing to the member units.

　　Article 14 The Association shall establish an industry credit system and a blacklist system, and cooperate with the competent government departments in establishing enterprise credit files.The member units' performance of this Convention shall be regularly published on the Association's website and promptly notified by letter to the supervision department of the public security organ.

　　Article 15 The Association shall sum up experience in time, set up examples, commend advanced collective and individuals, positively guide member units to voluntarily implement the convention, and incorporate the performance of member units into the industry evaluation or credit rating activities, as an important basis for the selection of members of the association's leading group.

　　Article 16 Depending on the seriousness of the circumstances, the Association may apply the following disciplinary measures to the member units that violate this Convention;

　　(1) Warning;

　　(2) circulate criticism within the industry;

　　(3) public exposure by the public media;

　　(4) suspension of membership for six months to one year;

　　(5) Cancellation of membership.

　　If the council member, vice president, executive vice president or president unit is punished in Item (3), (4) or (5) for violating this Convention, they shall be relieved of their corresponding posts in the association according to the procedures stipulated in the association's articles of association.

　　Article 17 The Association shall have the right to propose to the competent authorities of the government for administrative punishment for the member units that violate this Convention, if their acts also violate the provisions of laws, regulations and policies.

　　Chapter IV Supplementary Provisions

　　Article 18 If this Convention is in conflict with the relevant laws and regulations, it shall be executed in accordance with the relevant laws and regulations.

　　Article 19 The Secretariat of the Kunming Security Association shall be responsible for the interpretation of this Convention.

　　Article 20 This Convention shall enter into force through a vote at the first General Meeting of the Fifth Session of the Kunming Security Association on September 16, 2022.
