The Federation of Trade Unions and Civil Affairs Departments (bureaus) of all provinces, autonomous regions, and municipalities directly under the Central Government, the Civil Affairs Bureau of the Xinjiang Production and Construction Corps, all national industrial trade unions, the trade union federations of central and state organs, and all departments and units directly under the ACFTU:
In order to thoroughly study and implement the spirit of the 19th CPC National Congress and the second, third, fourth and fifth plenary sessions of the 19th CPC Central Committee and the Central Party's group work conference, earnestly implement the "opinions on reforming the Management system of Social organizations and promoting the healthy and orderly Development of Social organizations" issued by the General Office of the CPC Central Committee and the General Office of the State Council, and promote the establishment of trade unions and social organizations to play an important role in building a new pattern of grass-roots social governance, we hereby put forward the following opinions on strengthening the construction of trade unions of social organizations.
1. the Importance and General Requirements of Strengthening the Construction of Trade Unions in Social Organizations
(I) significance. With the deepening of reform and opening up, social organizations with social organizations, foundations and social service institutions as the main body have developed rapidly and have become an important force in socialist modernization and an important position for party work and mass work. The Fifth Plenary Session of the 19th Central Committee of the Communist Party of China proposed to give full play to the role of group organizations and social organizations in social governance, and smooth and standardize the ways for market entities, new social classes, social workers and volunteers to participate in social governance. The Central Party's group work conference emphasized that contacting and guiding relevant social organizations is an important task for group organizations to play a bridge and link role. Promoting the establishment of trade unions in social organizations is an inherent requirement for adhering to party building and mass building and implementing the spirit of the Central Party's mass work conference. Strengthen the construction of social organization trade unions, for safeguarding the legitimate rights and interests of social organization employees, and building harmonious labor relations; for uniting and leading social organization employees to listen to and follow the party, consolidate and expand the class foundation and mass foundation of the party's governance; for strengthening the labor union Political guidance, demonstration drive, and contact services of social organizations in the field, unite and guide social organizations in the field of labor, and promote the healthy and orderly development of social organizations, it is of great significance to promote social organizations to play a better role in the modernization of the national governance system and governance capacity. Trade unions and civil affairs departments at all levels should fully understand the importance and urgency of strengthening the construction of trade unions in social organizations, regard it as an important basic work, give full play to the advantages of their respective responsibilities, strengthen linkage and cooperation, and promote the implementation of the requirements of the Party Central Committee.
(II) general requirements. Adhere to the guidance of Xi Jinping Thought on Socialism with Chinese Characteristics for a New Era, thoroughly study and implement General Secretary Xi Jinping's important expositions on the work of the working class and trade unions, actively explore ways and methods of trade union construction that are in line with the reality of social organizations, and strive to solve the problems of insufficient coverage of trade unions in social organizations. Continuously expand the effective coverage of trade unions to social organizations and stimulate the vitality of social organizations, we should strengthen trade union contact and guide the work of social organizations, and give full play to the important role of trade unions in promoting the orderly participation of social organizations in social governance, providing social services and assuming social responsibility.
Main Responsibilities of 2. Social Organizations Trade Unions
(I) close contact with workers, strengthen political leadership. Organize and guide employees to study and implement Xi Jinping's thoughts on socialism with Chinese characteristics in the new era, study General Secretary Xi Jinping's important expositions on the work of the working class and trade unions, and continuously strengthen the "four consciousnesses", strengthen the "four confidences", and achieve the "two safeguards", Propaganda and implement the party's line, principles and policies, unswervingly listen to and follow the party, and always maintain a high degree of consistency with the Party Central Committee with Comrade Xi Jinping. Timely report to the Party organization at the same level and the higher trade union for instructions on major trade union matters. In social organizations that have established trade unions but have not yet established party organizations, trade unions should actively cooperate with higher-level party organizations to train and develop party members among trade union members, and give full play to the exemplary and leading role of party members to create conditions for the establishment of party organizations in social organizations.
(II) unite the workers and bring together the development forces. Strengthen the ideological and political guidance of employees, guide employees to actively practice socialist core values, and stimulate employees' sense of ownership and enthusiasm for work. Vigorously promote the spirit of model workers, labor spirit, and craftsmanship, carry out labor and skill competitions around the central tasks of social organizations, strengthen skill training, improve quality, and promote the establishment of a sound professional training, evaluation, use, and incentive mechanism. Support social organizations to participate in social governance in an orderly manner, provide social services, and assume social responsibilities.
(III) establish a sound mechanism to safeguard the rights and interests of employees. Through the democratic management system with the workers' congress as the basic form or other forms, organize employees to participate in the democratic decision-making, democratic management and democratic supervision of social organizations in an orderly manner. Important matters involving the immediate interests of employees shall be disclosed to employees in a timely manner. Guide and help employees and social organizations to conclude and perform labor contracts in accordance with the law, and standardize labor management. Supervise the implementation of relevant labor laws, regulations and policies by social organizations. We should establish and improve the system of collective consultation and collective contract, explore the establishment of industrial and regional consultation mechanisms, solve major issues involving the vital interests of employees through consultation, safeguard the legitimate rights and interests of employees, and build harmonious labor relations.
(IV) innovative ways and means, dedicated service workers. Adhere to the needs of employees as the guide, use modern information technology, organize and carry out a variety of cultural activities, and create a positive cultural atmosphere. Through the purchase of services, project cooperation and other ways, to provide professional and personalized services for employees. Pay attention to humanistic care and psychological counseling for employees, do a good job in helping employees in difficulties such as sending warmth and helping students in the golden autumn, and strive to improve the sense of gain, happiness, and security of the employees.
3. to expand the effective coverage of social organizations by trade unions
(I) promote social organizations to establish trade unions in accordance with the law. Focusing on social organizations registered with the civil affairs departments of the people's governments at or above the provincial level and private hospitals, schools, kindergartens, etc. registered with local civil affairs departments, we will carry out a thorough investigation and strive to use about three years to promote the establishment of trade unions by qualified social organizations. Significant breakthroughs have been made.
(II) reasonably determine the way to build the association. Adhere to the characteristics of social organizations, adopt flexible and diverse forms of organization, and expand the effective coverage of trade union organizations. Kill.
1. Establish trade union organizations according to the employing units. Social organizations with more than 25 trade union members in their units shall establish a separate grass-roots trade union committee; if there are less than 25 members, a grass-roots trade union committee may be established separately, or a grass-roots trade union committee may be jointly established by trade union members of two or more units, or an organizer or trade union chairman may be elected to preside over the work of the grass-roots trade union.
2. Establish trade union organizations by region and industry. In neighborhoods, parks, buildings and other areas where social organizations are relatively concentrated, regional trade union federations may be established. Industries with obvious industry characteristics and sound management systems, or relying on relevant management departments to establish comprehensive (industry) party committees of social organizations, can form industry trade union federations. Regional and industrial trade union federations are generally established below the county (city, district, and banner) level. If the conditions are met, the establishment of industrial trade union federations may be explored at the municipal level.
Township (street) and village (community) trade unions should strengthen the leadership of the construction of trade unions of social organizations in the region, extensively absorb workers to join the trade unions, promote social organizations to establish trade unions in accordance with the law, and give full play to the role of the region.
Extensive recruitment of employees in the (III). Strengthen publicity and mobilization and service attraction, and maximize the absorption of social organization workers into trade unions. For social organizations that have not yet established trade unions, employees can apply for membership to the township (street), development zone (industrial park), village (community) trade union and regional and industrial trade union federations where they work or live. The trade union should absorb them and do a good job in membership management; after the conditions are met, the higher-level trade union should promptly guide social organizations to form trade unions. Part-time employees of social organizations, etc., should join the trade union of their unit; employees who have not yet established a trade union in their unit can apply for membership to the trade union where the unit is located or where they live, or they can apply to join the trade union of the part-time social organization, and wait for the unit to establish a trade union. After that, the membership organization relationship will be transferred in time.
4. Standardize the Construction of Trade Unions in Social Organizations
(I) straighten out the leadership relationship between trade union organizations. The trade union of social organizations is under the dual leadership of the party organization at the same level and the trade union at the next higher level, with the leadership of the party organization at the same level as the main one. If no party organization is established, it shall be led by the trade union at the next higher level. According to the principle of territorial management, if the place of domicile of a social organization is inconsistent with the place of registration, a trade union shall be established in the place of domicile in principle and shall be led by the trade union of the place of domicile. The national social organization trade union in Beijing is mainly under the leadership of the party organization at the same level, and at the same time under the leadership of the trade union of the professional supervisory unit; if there is no professional supervisory unit but the party building work organization uniformly leads and manages the party building work, it is also under the leadership of the party building work organization trade union. The trade unions of national social organizations outside Beijing and social organizations below the provincial level are mainly led by the party organizations at the same level, and are also led by the local trade unions or related industrial trade unions in the place where they are located. Where social organization party building work institutions have been established in various places, places where conditions permit may rely on social organization party building work institutions to establish social organization trade union federations to guide the work of social organization trade unions in the region.
The (II) shall elect the chairman and vice-chairman of the trade union in accordance with the law. In accordance with the regulations on the Election of Trade Union Grass-roots organizations and the regulations on Grass-roots Trade Union members' Congress, standardize the election of trade union committees, funds examination committees and women workers' committees. The persons in charge of social organizations, legal representatives and their close relatives shall not be candidates for the chairman, vice-chairman and members of the trade union.
The selection and selection of the chairman, vice-chairman, and members of regional and industry trade union federations shall be implemented in accordance with the "Opinions of the All-China Federation of Trade Unions on Strengthening and Regulating the Construction of Regional and Industry Trade Union Federations.
Trade unions at higher levels may recommend candidates for trade union chairman and vice-chairman to trade union federations of social organizations and regional and professional trade union federations, and equip them with socialized trade union workers.
(III) efforts to build a home for workers. Social organizations and trade unions should strengthen the standardization of trade union organizations and trade union work in accordance with the "six haves" standard (I. e., there is a legally elected trade union chairman, an independent and sound organizational structure, an activity carrier to serve employees, a sound and complete system and mechanism, independent management of trade union funds, and trade union members' satisfactory work performance), and strive to build, turn and live. We will strengthen the management of the membership of trade unions and promote the management of social organizations and trade unions and members' real-name systems. We will carry out activities to build workers' homes, implement systems such as member evaluation, open conference affairs, and permanent membership representatives, and rely on members to build social organizations and trade unions into workers' homes trusted by employees. In accordance with the relevant provisions of the "Measures for the Management of Funds Revenue and Expenditure of Grassroots Trade Unions", standardize the financial budget management of social organizations and trade unions, and strictly use trade union funds.
5. Strengthen the Leadership of Social Organizations Trade Union Construction
(I) strengthen organizational leadership. Trade unions at all levels and civil affairs departments should attach great importance to the construction of trade unions in social organizations and pay close attention to them as an important task at present and in the future. We should actively strive for the support of the organization departments of local Party committees, strengthen the leadership and guidance for the construction of social organizations and trade unions, promote the role of social organizations and trade unions under the leadership of Party organizations, and lead the work with the mechanism of Party building and industrial construction. Improve and improve the working mechanism for the construction of social organizations and trade unions, and form a work pattern in which the party committee is under the unified leadership, the trade union is specifically responsible, the civil affairs department is supported, and the relevant departments perform their duties and manage together.
(II) strengthen coordination and linkage. Trade unions at all levels should strengthen communication and coordination with civil affairs departments, social organization party building work agencies, and professional supervisory units, regularly research and discuss work, share data and information, and work together to promote social organizations to establish trade unions in accordance with the law and standardize operations. Civil affairs departments at all levels should actively support and cooperate, provide data and information in a timely manner, do a good job in policy publicity and guidance, and support and promote the construction of trade unions in social organizations through appropriate forms such as incorporating the construction of trade unions into the evaluation indicators of social organizations. In promoting the establishment of social organization work coordination mechanism, should absorb the same level trade union participation.
(III) implementation of safeguards. Trade unions at all levels should urge social organizations to allocate trade union funds in full and on time, and support trade unions in exercising their rights and carrying out their work in accordance with the law. Support social organizations and trade unions to solve problems such as employee activity venues through separate construction, joint construction, and resource sharing. Increase financial support for the construction of trade unions in social organizations. Where conditions permit, higher-level trade unions can grant subsidies to part-time trade union cadres of social organizations, and special funds can be set up to ensure the normal operation of trade unions of smaller social organizations and regional and industry trade union federations. When trade union organizations at all levels purchase services from social organizations, they shall, under the same conditions, give priority to the purchase of services from established trade union organizations or social organizations covered by trade union work.
(IV) focus on precision. According to the actual situation of the scale of social organizations and the foundation of trade union work, we should adhere to the simultaneous development of construction and management, and constantly enhance the pertinence and effectiveness of trade union work. For social organizations that have not established trade unions, it is necessary to clarify the target time limit and take effective measures to promote the establishment of trade union organizations as soon as possible. For social organizations that have established trade unions, it is necessary to strengthen the standardization of trade unions and promote the role of trade unions. It is necessary to strengthen the education and training of trade union cadres and improve their ability to do a good job. It is necessary to increase publicity, cultivate and promote advanced models of social organization trade union work, and create a good atmosphere for social organization trade union work.
