China Trade Union Charter

General Provisions

The Chinese trade union is a mass organization of the working class under the leadership of the Communist Party of China, a bridge and link between the party and the masses of workers, an important social pillar of state power, and a representative of the interests of members and workers.

Chinese trade unions take the Constitution as the fundamental criterion for their activities, carry out their work independently in accordance with the the People's Republic of China Trade Union Law and these articles of association, and exercise their rights and perform their obligations in accordance with the law.

The working class is the leading class of our country, the representative of advanced productive forces and production relations, the most solid and reliable class foundation of the Communist Party of China, the main force of reform and opening up and socialist modernization, and a powerful and concentrated society that maintains social stability. force. The Chinese trade unions hold high the great banner of socialism with Chinese characteristics, guided by Marxism-Leninism, Mao Zedong Thought, Deng Xiaoping Theory, the important thinking of the "Three Represents", the scientific development concept, and Xi Jinping Thought on Socialism with Chinese Characteristics for a New Era, implement the party's economic construction as the center, adhere to the four basic principles, adhere to the basic line of reform and opening up, and maintain and enhance the political, advanced, and mass character, unswervingly follow the development path of socialist trade unions with Chinese characteristics, promote the implementation of the party's fundamental guiding principle of wholeheartedly relying on the working class, fully perform the social functions of trade unions, and better express and safeguard the overall interests of the people of the country. The specific interests of employees, unite and mobilize employees across the country to be self-reliant, work hard, and adhere to and develop socialism with Chinese characteristics, strive to build a well-off society in an all-round way, build our country into a prosperous, democratic, civilized, harmonious and beautiful modern socialist country, and realize the Chinese dream of the great rejuvenation of the Chinese nation.

The Chinese trade unions insist on consciously accepting the leadership of the Communist Party of China, assume the political responsibility of uniting and guiding the masses of workers to listen to and follow the party, and consolidate and expand the class and mass foundation of the party's governance.

The basic duty of the Chinese trade unions is to safeguard the legitimate rights and interests of employees and to serve the masses of employees wholeheartedly.

The Chinese trade union takes loyalty to the party's cause and dedicated service to employees as its own responsibility, adheres to the work policy of organizing and effectively safeguarding rights, adheres to the concept of employee-oriented, active and scientific rights protection in accordance with the law, promotes the improvement of socialist labor laws, and safeguards the economy of employees. Political, cultural and social rights, participate in the coordination of labor relations and social interest relations, promote the construction of harmonious labor relations, and promote high-quality economic development and long-term social stability, safeguard the unity of the working class and trade union organizations and contribute to the construction of a harmonious socialist society.

The Chinese trade unions safeguard the socialist state power of the people's democratic dictatorship led by the working class and based on the alliance of workers and peasants, assist the people's government in its work, and play the role of democratic participation and social supervision in accordance with the law.

In enterprises and institutions, Chinese trade unions, in accordance with the principle of promoting the development of enterprises and institutions and safeguarding the rights and interests of employees, support the administration in exercising management power in accordance with the law, organize employees to participate in democratic management and democratic supervision, and establish a consultation system with the administration to protect the legitimate rights and interests of employees. China's trade unions implement the principle of combining industry and local organization and leadership, and adhere to democratic centralism.

The enterprises and undertakings established by the trade union adhere to the public welfare and service nature, adhere to the service of reform and opening up and the development of social productive forces, serve the masses of workers, and promote the cause of labor movement.

The Chinese trade unions strive to consolidate and develop the worker-peasant alliance, adhere to the broadest patriotic united front, strengthen the great unity of the people of all ethnic groups throughout the country, including compatriots in the Hong Kong Special Administrative Region, the Macao Special Administrative Region, Taiwan compatriots and overseas Chinese, and promote the reunification of the motherland., Prosperity and prosperity.

China's trade unions adhere to the principles of independence, mutual respect, seeking common ground while reserving differences, strengthening cooperation and enhancing friendship in international affairs. On the basis of the principles of independence, equality, mutual respect and non-interference in each other's internal affairs, China's trade unions have extensively established and developed friendly relations with international and national trade union organizations, actively participated in the construction of "Belt and Road Initiative", and enhanced the friendship between China's working class and other countries, play a role in promoting the construction of a community with a shared future for mankind, and work together for world peace, development, cooperation, workers' rights and social progress.

Chinese trade unions implement the general requirements of party building in the new era, take the party's political construction as the command, comprehensively strengthen party building, enhance political awareness, overall situation awareness, core awareness, and alignment awareness, and strengthen road self-confidence, theoretical self-confidence, institutional self-confidence, and cultural self-confidence. Chapter I Members

Article 1 All manual and mental workers in enterprises, institutions, government agencies and other social organizations within the territory of China who rely on wages as their main source of income or who have established labor relations with their employers, regardless of nationality, race, sex, Occupation, religious belief, education level, recognized the constitution of the trade union, may join the trade union as a member.

Article 2 When an employee joins a trade union, he/she shall voluntarily apply for membership, which shall be approved by the basic level committee of the trade union and issued with a membership card.

Article 3 Members enjoy the following rights:

(I) the right to vote, to be elected and to vote.

(II) supervise the work of trade unions, put forward opinions and suggestions, and demand the replacement or removal of incompetent trade union staff.

(III) put forward criticisms and suggestions on the problems of national and social life and the work of their own units, and require trade union organizations to truthfully report to relevant parties.

(IV) demand protection from trade unions when their legitimate rights and interests are violated.

(V) the preferential treatment provided by the trade union in culture, education, sports, tourism, recuperation, mutual assistance, life assistance, legal services, employment services, etc.; various rewards given by the trade union.

(VI) participate in discussions on trade union work and workers' concerns at trade union meetings and trade union media.

Article 4 Members shall perform the following obligations:

(I) conscientiously study and implement Xi Jinping's thoughts on socialism with Chinese characteristics in the new era, and learn basic knowledge of politics, economy, culture, law, science, technology, and trade unions.

(II) actively participate in democratic management, strive to complete production and work tasks, and make contributions based on their posts.

(III) abide by the Constitution and laws, practice the core values of socialism, promote the traditional virtues of the Chinese nation, abide by social ethics, professional ethics, family virtues, and personal ethics, and abide by labor discipline.

(IV) correctly handle the interests of the state, the collective and the individual, and fight against acts that endanger the interests of the state and society.

(V) safeguard the unity and unity of the Chinese working class and trade union organizations, promote class friendship, and do a good job of mutual assistance.

(VI) abide by the trade union charter, implement trade union resolutions, participate in trade union activities, and pay monthly membership fees.

Article 5 The relationship of member organizations changes with the labor (work) relationship and is transferred with the membership certificate.

Article 6 Members have the freedom to withdraw from the meeting. The withdrawal of a member from the meeting shall be proposed by me to the trade union group, and the grass-roots committee of the trade union shall announce his withdrawal and withdraw his membership card.

If a member fails to pay membership dues or participate in the organizational life of the trade union for six consecutive months without a valid reason, and refuses to make corrections after education, it shall be regarded as an automatic withdrawal.

Article 7 Members who fail to implement trade union resolutions and violate trade union statutes shall be criticized and educated. Members who have committed serious violations of the law and have been subject to criminal sanctions shall be expelled from membership. The expulsion of a member from membership shall be subject to discussion by the trade union group, the opinions of which shall be decided by the grass-roots committee of the trade union and reported to the trade union at the next higher level for the record.

Article 8 Members who are retired, retired and unemployed may retain their membership. Membership is exempt during retention.

Trade union organizations should be concerned about the lives of retired, retired and unemployed members and actively reflect their wishes and demands to the parties concerned.

Chapter II Organizational System

Article 9 Chinese trade unions shall practice democratic centralism, the main contents of which are:

The (I) individual is subordinate to the organization, the minority is subordinate to the majority, and lower-level organizations are subordinate to higher-level organizations.

The leading organs of (II) trade unions at all levels, with the exception of the representative organs they send, are democratically elected.

The highest leading body of the (III) trade union is the National Congress of the Trade Union and the Executive Committee of the All-China Federation of Trade Unions. The local leading organs of trade unions at all levels are the local congresses of trade unions at all levels and the committees of trade unions of trade unions formed by them.

(IV) trade union committees at all levels shall be responsible to and report on their work to the general assembly or representative assembly at the corresponding level, and shall be subject to the supervision of their members. The members' assembly and the members' representative assembly shall have the power to replace or recall the deputies and members of the trade union committee elected by them.

(V) trade union committees at all levels shall adopt a system of combining collective leadership with division of labor and responsibility. All major issues are discussed and decided by the committee, and the members of the committee perform their duties in accordance with collective decisions and division of labor.

(VI) the leading organs of trade unions at all levels, strengthen their leadership and services to lower-level organizations, regularly inform lower-level organizations, listen to the opinions of lower-level organizations and members, and study and solve problems raised by them. Lower-level organizations should promptly request instructions from higher-level organizations to report their work.

Article 10 The selection of delegates and committees of trade union congresses at all levels shall fully reflect the will of the electors. The list of candidates should be repeatedly deliberated and fully discussed. The election shall be conducted by secret ballot, and the formal election may be conducted directly by means of a differential election in which the number of candidates exceeds the number of candidates to be elected, or the preliminary election may be conducted by means of a differential election to produce a list of candidates, and then a formal election may be conducted. No organization or individual may in any way compel an elector to elect or not to elect a person.

Article 11 Chinese trade unions shall apply the principle of organization and leadership based on the combination of industry and local areas. Members of the same enterprise, institution, government organ and other social organizations shall be organized in a grass-roots trade union organization; in the same industry or several industries of a similar nature, national or local industrial trade union organizations shall be established as needed. Except for a few industries that implement vertical management of the administrative management system, their industrial trade unions implement the dual leadership of industrial trade unions and local trade unions, with the leadership of industrial trade unions as the mainstay, other industrial trade unions implement the leadership of local trade unions and accept the leadership of higher-level industrial trade unions. system. The leadership system of trade unions in various industries shall be determined by the All-China Federation of Trade Unions.

Provinces, autonomous regions, municipalities directly under the Central Government, cities divided into districts and autonomous prefectures, counties (banners), autonomous counties, and cities not divided into districts shall establish local federations of trade unions. The local federation of trade unions is the leading organ of local trade union organizations and local industrial trade union organizations. A unified All-China Federation of Trade Unions shall be established throughout the country. The All-China Federation of Trade Unions is the leading organ of the local federation of trade unions at all levels and the national organization of trade unions in various industries.

Members of the Executive Committee of the All-China Federation of Trade Unions and members of the National Committee of Industrial Trade Unions shall implement a substitute system. Members of local trade union committees at all levels and members of local industrial trade union committees may also implement a substitute system.

Article 12 Local committees of trade unions at and above the county level may, according to the needs of their work, send representative organs.

Trade union committees at and above the county level may, between congresses and when they deem it necessary, convene meetings of deputies to discuss and decide on major issues that need to be resolved in a timely manner. The number of delegates to the conference and the method of selection shall be determined by the Federation of Trade Unions convening the conference.

The committees of the national industrial trade unions, local industrial trade unions at all levels, township trade unions and urban street trade unions may, in accordance with the principles of association and representation, be composed of the democratically elected principal responsible persons of the trade union organizations at the next lower level and an appropriate proportion of representatives of the parties concerned.

The trade union at a higher level may send personnel to help and guide the employees of the employing unit to form a trade union.

Article 13 The trade union congresses at all levels shall elect the funds examination committees at the same level. The Funds Review Committee of the All-China Federation of Trade Unions shall have a standing committee, and the Funds Review Committee of the Federation of Trade Unions of provinces, autonomous regions, and municipalities directly under the Central Government and the National Industrial Trade Union Funds Review Committee that independently manages funds shall have a standing committee. The funds review committee is responsible for reviewing the funds revenue and expenditure and asset management of the trade union organizations at the same level and their directly affiliated enterprises and institutions, supervising the implementation of financial laws and regulations and the use of trade union funds, and accepting the guidance and supervision of the higher-level trade union funds review committee. The trade union funds review committee shall be responsible and report its work to the general assembly or representative assembly at the same level; when the general assembly is not in session, it shall be responsible and report its work to the trade union committee at the same level.

The higher-level funds review committee shall review the funds revenue and expenditure and asset management of the next-level trade union and its directly affiliated enterprises and institutions.

The members of the Funds Review Committee of the All-China Federation of Trade Unions shall implement a substitute system. Members of the Funds Review Committee of the Local Federation of Trade Unions at all levels and members of the Funds Review Committee of the Industrial Trade Union that independently manage funds may also implement a substitute system.

Article 14 Trade unions at all levels shall establish female workers' committees to express and safeguard the legitimate rights and interests of female workers. The women workers' committee shall be nominated by the trade union committee at the same level and formed or elected on the basis of full consultation. The women workers' committee and the trade union committee shall be established at the same time and work under the leadership of the trade union committee at the same level. The women workers' committee of the enterprise trade union is a group member of the women's federation at or above the county level, and receives the professional guidance of the women's federation through the local trade union at or above the county level.

Article 15 Trade union organizations at and above the county level shall establish legal service organizations to provide services for the protection of the legitimate rights and interests of workers and trade union organizations.

Trade union organizations at all levels shall organize and represent employees to carry out labor law supervision.

Article 16 The establishment or abolition of a trade union organization must be approved by the general assembly or representative assembly and submitted to the trade union at the next higher level for approval. If the enterprise in which the grass-roots trade union organization is located terminates, or the institution, organ or other social organization in which it is located is abolished, the trade union organization shall be abolished accordingly and shall be reported to the trade union at a higher level for the record. Other organizations and individuals may not abolish trade union organizations at will, nor may the institutions of trade union organizations be abolished, merged or assigned to other work departments.

Chapter III National Organizations

Article 17 The National Congress of Chinese Trade Unions shall be held once every five years and shall be convened by the Executive Committee of the All-China Federation of Trade Unions. Under special circumstances, it may be proposed by the presidium of the Executive Committee of the All-China Federation of Trade Unions and approved by the plenary meeting of the Executive Committee. The number of deputies and the method of election shall be decided by the All-China Federation of Trade Unions.

Article 18 The functions and powers of the National Congress of Chinese Trade Unions are:

(I) examine and approve the work report of the executive committee of the all-china federation of trade unions.

(II) review and approve the report on the income and expenditure of the Executive Committee of the All-China Federation of Trade Unions and the work report of the Funds Review Committee.

(III) to amend the constitution of the Chinese trade unions.

(IV) elects the ACFTU Executive Committee and the Funding Review Committee.

Article 19 The Executive Committee of the All-China Federation of Trade Unions shall, when the National Congress is not in session, be responsible for implementing the resolutions of the National Congress and leading the work of trade unions throughout the country.

The plenary meeting of the Executive Committee elects a chairman, several vice-chairmen, and several members of the presidium to form the presidium.

The plenary meetings of the Executive Committee shall be convened by the Presidium and shall be held at least once a year.

Article 20 When the plenary session of the Executive Committee of the All-China Federation of Trade Unions is not in session, the presidium shall exercise the functions and powers of the Executive Committee. Plenary meetings of the Presidium, convened by the Chairman.

When the Bureau is not in session, the Chairman's meeting composed of the Chairman and the Vice-Chairmen shall exercise the functions of the Bureau. the chairmanship meeting is convened and presided over by the chairman of the all-china federation of trade unions.

The Presidium shall have a Secretariat, which shall be composed of a first secretary elected by the Presidium from among the members of the Presidium and a number of secretaries. Under the leadership of the Presidium, the Secretariat presides over the day-to-day work of the All-China Federation of Trade Unions.

Article 21 The establishment of the national organization of industrial trade unions shall be determined by the All-China Federation of Trade Unions according to needs.

The establishment of the National Committee of Industrial Trade Unions, approved by the All-China Federation of Trade Unions, may be formed in accordance with the principles of association and representation, or may be elected by the National Congress of Industrial Trade Unions. The term of office of the National Committee is five years. When the term of office expires, a meeting shall be held as scheduled to conduct a general election. Under special circumstances, with the approval of the All-China Federation of Trade Unions, it may be held in advance or postponed.

The functions and powers of the National Congress of Industrial Trade Unions and the plenary session of the National Committee of Industrial Trade Unions formed in accordance with the principles of association and representation are: to consider and approve the work report of the National Committee of Industrial Trade Unions; to elect the National Committee of Industrial Trade Unions or the Standing Committee of the National Committee of Industrial Trade Unions. An industrial trade union that manages funds independently shall elect a fund review committee and report its work to the National Congress of the Industrial Trade Union or the plenary meeting of the committee. The Standing Committee of the National Committee of Industrial Trade Unions is composed of a chairman, a number of vice-chairmen, and a number of standing members.

Chapter IV Local Organizations

Article 22 The trade union congresses of provinces, autonomous regions, municipalities directly under the Central Government, cities divided into districts and autonomous prefectures, counties (banners), autonomous counties and cities not divided into districts shall be convened by the committees of the trade unions at the same level and shall be held every five years. Under special circumstances, it may be held in advance or postponed upon the proposal of the trade union committee at the same level and with the approval of the trade union at the next higher level. The functions and powers of the local congresses of trade unions at all levels are:

(I) review and approve the work reports of the committees of trade unions at the same level.

The (II) shall review and approve the report on the income and expenditure of the funds of the committees of the Federation of Trade Unions at the same level and the work report of the funds review committee.

The (III) elects the Board of Trade Unions and the Funds Review Committee at the same level.

When the congress is not in session, local committees of trade unions at all levels shall implement the decisions of the trade unions at higher levels and the resolutions of the trade union congresses at the same level, lead the work of the trade unions in their respective regions, and regularly report their work to the committees of the trade unions at higher levels.

According to the needs of the work, the provincial and autonomous regional federation of trade unions may set up representative organs in the region. The federations of trade unions of municipalities directly under the Central Government and cities divided into districts shall establish federations of trade unions at the district level.

Counties and urban districts may establish township trade unions and street trade union organizations in towns and streets, and if conditions permit, establish trade unions.

Article 23 The committees of local trade unions at all levels elect a chairman, a number of vice-chairmen, and a number of standing committee members to form a standing committee. The results of the election of the trade union committee, the standing committee, the chairman, vice-chairman and the funds examination committee shall be submitted to the Federation of Trade Unions at the next higher level for approval.

The plenary meetings of the committees of local trade unions at all levels shall be held at least once a year and shall be convened by the standing committees. The standing committees of local federations of trade unions at all levels exercise the functions and powers of the committees when the plenary meetings of the committees are not in session.

Article 24 The establishment of local industrial trade union organizations at all levels shall be determined by the local federation of trade unions at the same level in the light of the actual conditions of the region.

Chapter V Grassroots Organizations

Article 25 Enterprises, institutions, government agencies, other social organizations and other grass-roots units shall establish trade unions in accordance with the law. Communities and administrative villages may establish trade union organizations. Proceeding from reality, establish regional and industrial trade union federations, and promote the construction of new economic organizations and new social organizations.

If there are more than 25 members, a grass-roots trade union committee shall be established; if there are less than 25 members, a grass-roots trade union committee may be established separately, or a grass-roots trade union committee may be jointly established by members of two or more units, or an organizer or a trade union chairman may be elected to preside over the work of the grass-roots trade union. If there are more than 10 women members in the grass-roots committees of trade unions, women workers' committees shall be established; if there are less than 10, women workers' committees shall be established.

The trade union of an enterprise or institution with more than 200 employees shall have a full-time trade union chairman. The number of full-time workers of a trade union shall be determined by the trade union through consultation with the enterprise or institution.

A grass-roots trade union has the qualifications of a legal person and has obtained the status of a legal person in accordance with the law, and the chairman of the trade union is the legal representative.

Article 26 The general assembly or representative assembly of the grass-roots organizations of trade unions shall be held at least once a year. Upon the proposal of the basic-level trade union committee or 1/3 or more trade union members, a general meeting or a representative meeting of members may be convened temporarily. A grass-roots trade union with less than 100 trade union members shall convene a general meeting of its members.

The functions and powers of the general assembly or representative assembly of trade unions are:

(I) review and approve the work reports of trade union grass-roots committees.

The (II) shall examine and approve the reports on the income and expenditure of funds of the grass-roots committees of trade unions and the work reports of the funds examination committees.

(III) election of trade union grass-roots committees and funding review committees.

(IV) remove or recall the representatives or members of the trade union committee they have elected.

(V) discuss major issues that determine the work of the union.

The term of office of the trade union grass-roots committee and the fund review committee is three to five years, and the specific term of office shall be decided by the general assembly or the general assembly of members. When the term of office expires, a meeting shall be held as scheduled to conduct a general election. Under special circumstances, it may be held earlier or later with the approval of the trade union at the next higher level.

Deputies to the members' congress shall be subject to a permanent system, and their term of office shall be the same as that of the trade union committee of the unit.

Article 27 The members of the trade union grass-roots committees shall be elected on the basis of full deliberation and consultation among the members or their representatives; the chairman and vice-chairmen may be directly elected by the general assembly or the representative assembly of members, or may be elected by the trade union grass-roots committees. The trade union committee of a large enterprise or institution may, in accordance with the needs of its work and with the approval of the trade union committee at a higher level, set up a standing committee. The results of the election of the basic-level committees, standing committees, chairmen, vice-chairmen and funds examination committees of trade unions shall be reported to the trade unions at the next higher level for approval.

Article 28 The basic tasks of the basic-level committees of trade unions are:

(I) implement the resolutions of the members' assembly or the members' representative assembly and the decisions of the trade union at a higher level, and preside over the daily work of the grass-roots trade union.

(II) representatives and organize employees to participate in the democratic management and democratic supervision of their own units through the employee representative assembly, factory affairs disclosure and other forms in accordance with the law, and implement the system of employee directors and employee supervisors in corporate enterprises. The trade union committee of an enterprise or institution is the working body of the workers' congress, which is responsible for the daily work of the workers' congress and inspects and supervises the implementation of the resolutions of the workers' congress.

(III) participate in the coordination of labor relations and mediation of labor disputes, establish a consultation system with the administrative aspects of enterprises and institutions, and resolve issues involving the vital interests of employees through consultation. Assist and guide employees to sign and perform labor contracts with the administrative authorities of enterprises and institutions, sign collective contracts or other special agreements with the administrative authorities of enterprises and institutions on behalf of employees, and supervise their implementation.

(IV) organize employees to carry out activities such as labor and skill competitions, rationalization suggestions, skill training, technological innovation and technical cooperation, cultivate craftsmen, and summarize and promote advanced experience. Article 29 The trade unions of education, scientific research, culture, health, sports and other institutions and agencies shall proceed from the characteristics of the relatively concentrated mental workers to carry out their work, actively understand and care about the thinking, work and life of employees, and promote the party's intellectual policy Implementation. Organize the staff and workers to do a good job in the democratic management and democratic supervision of their own units, so as to create good conditions for giving full play to the wisdom and talents of the staff and workers.

Article 30 Trade union grass-roots committees may, according to the needs of their work, establish trade union committees of branch factories and workshops (sections) in branch factories and workshops (sections). The trade union committee of the branch factory, workshop (department) shall be elected by the general assembly or representative assembly of the branch factory, workshop (department), and the term of office shall be the same as that of the grass-roots committee of the trade union.

Trade union grass-roots committees and committees of branch factories and workshops (sections) may set up several special committees or special groups as needed.

Establish trade union groups according to production (administrative) teams, democratically elect trade union group leaders, and actively carry out trade union group activities.

Chapter VI Trade Union Cadres

Article 31 Trade union organizations at all levels shall, in accordance with the requirements of revolutionization, youth, knowledge, and specialization, strive to build a team of cadres who adhere to the party's basic line, are familiar with their own business, love trade union work, and are trusted by employees.

Article 32 Trade union cadres shall strive:

(I) conscientiously study Marxism-Leninism, Mao Zedong thought, Deng Xiaoping Theory, the important thinking of "three represents", the scientific concept of development, and Xi Jinping's thought of socialism with Chinese characteristics in the new era. study politics, economy, history, culture, science and technology, law and trade union business, improve political ability and enhance the ability of the masses to work.

(II) implement the party's basic line and various principles and policies, abide by national laws and regulations, and have the courage to blaze new trails in reform, opening up, and socialist modernization.

(III) have firm beliefs, be loyal to their duties, work diligently, dare to take responsibility, be honest in performing official duties, take into account the overall situation, and maintain unity.

(IV) adhere to the principle of seeking truth from facts, conscientiously investigate and study, and truthfully reflect the opinions, wishes and demands of the staff and workers.

(V) adhere to principles, do not seek personal gain, enthusiastically speak for employees, and safeguard the legitimate rights and interests of employees in accordance with the law.

(VI) work style democracy, connect with the masses, enhance the awareness and feelings of the masses, and consciously accept the criticism and supervision of the masses of workers.

Article 33 Trade union organizations at all levels manage trade union cadres in accordance with relevant regulations, attach importance to the discovery, training and selection of outstanding young cadres, female cadres, and minority cadres, and become important bases for training cadres.

The chairmen and vice-chairmen of grass-roots trade unions shall not be transferred at will until the expiration of their terms of office. In case of transfer due to work needs, prior consent shall be obtained from the trade union committee at the corresponding level and the trade union at the next higher level.

Article 34 Trade union organizations at all levels shall establish and improve the cadre training system. The trade union cadres colleges and universities and various training courses are well run.

Article 35 Trade union organizations at all levels are concerned about the ideology, study and life of trade union cadres, supervise the implementation of corresponding treatment, support their work, and resolutely fight against acts of retaliation against trade union cadres.

Trade unions at or above the county level shall set up a fund to guarantee the rights and interests of trade union cadres to ensure that trade union cadres perform their duties in accordance with the law.

Trade unions at and above the county level may select and employ staff for grass-roots trade unions.

Chapter VII Trade Union Funds and Assets

Article 36 The sources of trade union funds:

(I) membership dues.

(II) the funds allocated by enterprises, institutions, government agencies and other social organizations to the trade union at the 2% of the total wages of all employees or the preparatory fund for the establishment of the association.

(III) income paid by enterprises and institutions affiliated to trade unions.

(IV) subsidies from people's governments, enterprises, institutions, government agencies and other social organizations.

(V) other income.

Article 37 Trade union funds shall be mainly used to serve the staff and workers and to carry out trade union activities. Trade union organizations at all levels should adhere to the correct direction of use, strengthen budget management, optimize the expenditure structure, and carry out supervision and inspection.

Article 38 Trade unions at and above the county level shall, in cooperation with taxation, finance and other relevant departments, do a good job in the collection of trade union funds and the appropriation of trade union funds that should be borne by the finance in accordance with the regulations.

Enterprises, institutions, government agencies and other social organizations that have not established trade unions shall allocate to the higher-level trade unions preparatory funds for the establishment of trade union associations based on the 2% of total wages.

A trade union with the legal personality of an association shall establish an independent fund account in accordance with the law.

Article 39 Trade union assets are the assets of social organizations, and the All-China Federation of Trade Unions has the ultimate ownership of the assets of trade unions at all levels. Trade unions at all levels shall strengthen the supervision and management of trade union assets in accordance with laws and regulations, protect trade union assets from damage, and promote the maintenance and appreciation of trade union assets. In accordance with the principle of financial independence, establish a budget, final accounts, asset supervision and fund review and supervision system. Implement a financial system of "unified leadership and hierarchical management", an asset supervision system of "unified ownership, hierarchical supervision, and unit use", and a funding review and supervision system of "unified leadership, hierarchical management, hierarchical responsibility, and lower review. Measures for the management and use of trade union funds and assets, as well as the examination and supervision system for trade union funds, shall be formulated by the All-China Federation of Trade Unions.

Article 40 Trade union committees at all levels shall prepare and approve budgets and final accounts in accordance with regulations, regularly report to the general assembly or the representative assembly of members and the trade union committee at the next higher level on the income and expenditure of funds and asset management, and accept the examination and supervision of the funds examination committee of the trade union at the next higher level and at the same level.

Article 41 Trade union funds, assets, real estate and assets formed by funds allocated to trade unions by the State, enterprises and institutions shall be protected by law, and no unit or individual shall embezzle, misappropriate or arbitrarily allocate them; without approval, it shall not change the affiliation and property rights of enterprises and institutions to which trade unions belong.

If a trade union organization is merged, its funds and assets shall be owned by the trade union after the merger; if a trade union organization is abolished or dissolved, its funds and assets shall be disposed of by the trade union at a higher level.

Chapter VIII Emblem

Article 42 The emblem of the Chinese trade union shall be composed of the Chinese characters "Zhong" and "Gong", which are formed by overlapping circles in artistic form, and a round line is added to the two characters, symbolizing the unity and unity of the Chinese trade union and the Chinese working class. The standards for making the emblem shall be stipulated by the All-China Federation of Trade Unions.

Article 43 The emblem of the Chinese trade union may be hung at the office, activity and meeting places of the trade union, and may be used as a trade union logo on souvenirs and office supplies, or worn as a badge.

Chapter IX Supplementary Provisions

Article 44 The power of interpretation of these Articles of Association shall be vested in the All-China Federation of Trade Unions.
