Chapter I General Provisions
Article 1 in order to standardize the discipline enforcement work of League organizations at all levels and promote the comprehensive and strict administration of the League, these rules are formulated in accordance with the Constitution of the Communist Youth League of China, the regulations on Disciplinary actions of the Communist Youth League of China (for trial implementation) and relevant regulations within the League, combined with the practice of League disciplinary punishment.
Article 2 The disciplinary sanctions of the regiment shall adhere to the principles of equality before the regiment discipline, seeking truth from facts, democratic centralism and education, and both leniency and strictness, so that the facts are clear, the evidence is conclusive, the nature is accurate, the handling is appropriate, and the procedures are in compliance.
Article 3 These Rules shall apply to the work related to the disciplinary action of the regiment.
Chapter II General Principles of Disposition
Article 4 Classification. The working authority of punishing members who violate discipline is mainly determined according to the affiliation of the members. The higher-level league organizations have the right to order the lower-level league organizations to investigate, verify and deal with the disciplinary violations of the league members under their management. If there is a dispute between league organizations over management matters, it shall be determined by their common superior league organization.
For a league organization that violates the discipline of the league, the higher-level league organization shall order it to make an inspection or issue a notice of criticism. For a regiment organization that seriously violates the discipline of the regiment and cannot be corrected by itself, the committee of the regiment at the next higher level shall, after finding out and verifying it, recommend to the party organization at the same level to be reorganized or dissolved according to the seriousness of the circumstances; if there is no party organization at the same level, the committee of the regiment at the next higher level may be directly reorganized or dissolved.
Article 5. If the staff member is the close relatives, witnesses or interested parties of the investigated person under examination or the whistleblower, or if there are other circumstances that may affect the fair handling, he shall not participate in the relevant regiment disciplinary work and shall take the initiative to apply for withdrawal. The investigated person under examination, the whistleblower and other relevant personnel also have the right to request him to withdraw.
Article 6 is strictly confidential. Staff should control the scope and time limit of knowledge of relevant work, and are not allowed to keep, conceal, consult, extract, copy, carry clues and related materials without permission, and are strictly prohibited to disclose investigation work, etc.
Article 7 is regulated and orderly. The disciplinary punishment of the regiment shall be carried out in strict accordance with the prescribed subject, scope, procedures and approval (approval) authority, and no individual or organization is allowed to make decisions or approve (approve) approval without authorization.
Chapter III Authority for Approval (Approval)
Article 8 the disciplinary punishment of League members shall generally be discussed and approved by the general meeting of the branch, and shall be reported by the grass-roots committee to the plenary meeting of the committee, the standing committee of the committee or the special meeting of the secretary at or above the county level for approval. Under special circumstances, the plenary meeting of the committee, the standing committee of the committee or the special meeting of the secretary of the regiment at or above the county level shall have the right to directly impose disciplinary sanctions on the regiment. Among them, those who are expelled from the regiment must be decided by the regiment committee at or above the county level and reported to the plenary meeting of the provincial committee of the regiment, the standing committee of the committee, or the special meeting of the secretary for approval.
Central enterprises, provincial enterprises with more than 200 members, and ministerial (provincial) university league committees may also approve or directly impose disciplinary sanctions on the league. Among them, those who are expelled from the regiment shall be reported to the plenary meeting of the provincial committee of the regiment, the standing committee of the committee or the special meeting of the secretary for approval.
The work guidance and promotion committee of the trade group is not responsible for the disciplinary action of the members, and the disciplinary action of the members it contacts shall be subject to the examination and approval procedures in accordance with the organizational relationship of the members.
Article 9 the Youth League committees at or above the county level may give the members and alternate members of the committees at the corresponding level to remove their posts in the regiment, stay in the regiment for probation or be expelled from the regiment.
When the plenary meeting of the committee is not in session, the Standing Committee of the committee may first make a decision to give the members or alternate members at the same level to remove their posts in the regiment, stay in the regiment for probation or be expelled from the regiment, which shall be ratified when the plenary meeting is held.
The Standing Committee of the committee approves the following sanctions: give warnings and serious warnings to members and alternate members of the committee at the same level; give members and alternate members of the committee at the next level to remove their positions in the regiment, stay in the regiment for probation, or be expelled from the regiment.
Article 10 disciplinary sanctions shall be given to League members who have held more than two (including two) posts in the regiment, and the examination and approval procedures shall be performed in accordance with the highest level of the regiment.
Article 11 If the punishment of a member needs to be changed or revoked, or involves the restoration of the rights of the member, the group organization that originally approved (approved) the punishment shall perform the examination and approval procedures.
Article 12 If a member of a disciplinary team is exempted from disciplinary sanctions, the examination and approval procedures shall be performed in accordance with the approval authority for giving him a warning.
Article 13 A league member whose organizational relationship has been transferred out but has not yet been accepted shall be given disciplinary sanctions, and the original league organization shall perform the examination and approval procedures. If the regiment organization has been revoked or is unable to perform the relevant procedures, the examination and approval procedures shall be carried out by the regiment organization that continues to exercise its functions and powers or by the regiment organization at the next higher level.
Article 14 For those who should be punished by the removal of their positions in the league, and the positions are appointed by the party organization, the league organization that approved the sanction shall recommend the corresponding party organization to remove their positions after the disciplinary sanction is made in accordance with the procedures.
Chapter IV Chapter IV Punishment Acceptance and Examination and Investigation
Article 15 if League organizations at all levels find clues related to League members' violation of discipline and are within the scope of their own management, they shall put forward suggestions for acceptance within one month from the date of receiving the clues. If the relevant clues are not within the scope of the organization's management, they shall be forwarded to the relevant league organization within 15 working days.
Article 16 after preliminary verification, if the League members pointed to by clues are suspected of violating discipline, they shall be examined and investigated, including on-the-spot visits, evidence collection, conversation and correspondence, and so on.
Article 17 After the investigation, a work report shall be written, setting out the basic information, the source of clues, the main causes, the investigation, the handling suggestions and the basis.
Article 18 League organizations at all levels shall establish administrative ledgers for the acceptance of sanctions, examination and investigation, and specify the handling process.
Chapter V Disposition and Approval
Article 19 the general meeting of the League branch shall discuss the disciplinary punishment of League members only when more than half of the members with the right to vote are present at the meeting, and the approval shall be approved by more than half of the members with the right to vote at the meeting. After the discussion is passed, it must be reported to the grassroots committee within 15 working days.
Article 20 The grassroots committee of the regiment deliberates and makes a decision on disciplinary sanctions of the regiment. It must have more than 2/3 members present before it can proceed, and the decision must be made by a majority of more than 2/3 members present. After the decision is made, it must be reported to the county-level or above-county-level committee for approval within 15 working days.
Article 21 The plenary meeting of the committees at the county level and above, the standing committee of the committee, or the special meeting of the secretary of the regiment to deliberate on the disciplinary decision of the regiment must be attended by more than 2/3 persons before it can be carried out, and it must be 2/3 by the people present at the meeting. Decided by a majority.
Article 22 if a League member violates discipline and is suspected of committing a crime, the decision on disciplinary punishment of the League shall, in principle, be made before the result of the handling by the judicial organ. If the case is difficult and complicated, and it is difficult to grasp the factual evidence and the nature of the behavior, or there are major disputes, which may affect the results of the disciplinary punishment of the regiment, the decision on the disciplinary punishment of the regiment may be postponed with the consent of the committee of the regiment at or above the county level, in principle No later than three months after the judicial organ's handling results.
Article 23 The disciplinary decision of the regiment shall take effect from the date of the decision of the regiment organization with the authority to approve (approve) the disciplinary action.
Chapter VI Announcement, Record and Filing of Disposition
Article 24 after the decision on disciplinary punishment of the regiment is made, it shall be announced to all members of the League organization of the punished member and himself within one month by the League organization that made the decision or the League organization of the punished member.
After a league member under the age of 18 is punished by the league for illegal crimes, the league organization that made the punishment decision shall notify him and his guardian within one month, and no longer announce to all members of the league organization where the punished member belongs.
Article 25 those who have been given a warning or above shall be recorded in the League members' files (including electronic files) by the League organization that made the punishment decision. The disciplinary records of League members under the age of 18 shall be properly kept and shall not be provided to other units or individuals without the consent of the provincial committee or the Central Committee of the League.
Article 26 The league organization that implements the disciplinary decision of the league shall report the implementation of the disciplinary decision to the league organization that made or approved (approved) the disciplinary decision within three months.
Article 27 After the disciplinary sanction of the regiment is approved (approved), the grassroots committee of the regiment where the punished member is located shall report to the grassroots committee of the party at the same level for the record.
Chapter VII Supplementary Provisions
Article 28 The Organization Department of the Central Committee of the Communist Youth League is responsible for the interpretation of these rules.
Article 28 These Rules shall enter into force as of the date of issuance.
